Health Disclaimer: PEAKNESS provides workout planning for informational purposes only. It is not a substitute for professional medical or fitness advice. Consult a qualified healthcare provider before starting any exercise programme, especially if you have a medical condition or injury.

By downloading or using the PEAKNESS app ("App") or subscribing through our website, you agree to these Terms of Use. If you do not agree, do not use the service.

1. The Service

PEAKNESS is a fitness planning application that helps you create, log, and track workout sessions. Workout plans are generated based on the preferences and goals you provide.

2. Eligibility

You must be at least 13 years old to use the service. By using it you confirm that you meet this requirement.

3. Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at awod.dev@gmail.com if you suspect unauthorised access.

4. Subscriptions and Billing

PEAKNESS is a paid service with a PRO subscription. PRO can be purchased inside the App through the App Store or Google Play, or on our website through Stripe. Some plans begin with a free trial: your payment method is saved at checkout but only charged when the trial ends, and you can cancel before then and pay nothing.

  • Web subscriptions renew automatically, monthly or yearly depending on the plan you chose, until you cancel. You can cancel at any time from the account page on this website; your access then continues until the end of the period you already paid for.
  • Subscriptions purchased inside the App are billed and managed by the App Store or Google Play, and are cancelled through your account with them.
  • If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal for web purchases. By subscribing you agree that the service starts immediately. If you withdraw within those 14 days by contacting us, we will refund your payment, minus a proportionate amount for the days the service was already provided.
  • If a subscription price changes, we will inform you in advance and the new price applies from your next renewal, so you can cancel first if you disagree.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose.
  • Attempt to reverse-engineer, copy, or redistribute the App or its content.
  • Interfere with or disrupt the service or its underlying infrastructure.
  • Use the service in any way that could harm others.

6. Health and Safety

Exercise carries inherent risks. You are solely responsible for assessing whether any workout plan is appropriate for your fitness level and health status. We are not liable for any injury, illness, or other harm that may result from following content in the App.

7. No Medical Advice

Nothing in the service constitutes medical, clinical, or professional fitness advice. Always consult a qualified professional before beginning a new exercise programme.

8. Intellectual Property

All content, design, and software in the service are owned by or licensed to us. You may not copy, reproduce, or distribute any part of it without our prior written consent.

9. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that it will be uninterrupted, error-free, or that workout plans will produce specific fitness results.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to personal injury, data loss, or loss of revenue.

11. Termination

We may suspend or terminate your access to the service at any time for violation of these Terms. You may stop using the service at any time and request account deletion by contacting us.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions.
